| چکیده | ||
| هدف این پژوهش تحلیل چندلایه رابطه ایدئولوژی و قانون در سیر تحول اندیشه فلسفی معاصر است؛ رابطهای که در ادبیات فلسفه حقوق اغلب بهصورت تکبعدی یا تقلیلگرایانه تبیین شده و از پیچیدگیهای آن غفلت شده است. این مقاله با تمرکز بر سه رویکرد محوری هابرماس، فوکو و رانسیر و با در نظر گرفتن پیشزمینههای نظریِ شکلدهنده آنها نزد آلتوسر، آرنت و لُفور، در پی آن است که نشان دهد چرا امتزاج ایدئولوژی با قانون هم بدیهی و هم گریزان از فروکاست است؛ امری که از آن با عنوان «سهل ممتنع» یاد میشود. از نظر روششناختی، پژوهش حاضر بر تحلیل مفهومی–انتقادی و تبارشناسی گفتمانهای حقوقی استوار است و از متون اصلی سه متفکر برای استخراج الگوهای هنجاری، قدرتمحور و نزاعی در فهم قانون بهره میگیرد. یافتههای پژوهش نشان میدهد که قانون در سه سطح با ایدئولوژی پیوند میخورد؛ سطح گفتمانیِ مشروعیتبخش نزد هابرماس، سطح انضباطی– قدرتی نزد فوکو و سطح نزاعی– رهاییبخش نزد رانسیر. این سه سطح نه قابل ادغام در یک نظریهاند و نه قابل تقلیل نسبت به یکدیگر؛ بلکه در مجموع تصویری چندلایه از کارکرد ایدئولوژیک قانون فراهم میآورند. نتیجه نهایی مقاله آن است که قانون نه صرفاً ابزار مشروعیت، نه صرفاً سازوکار قدرت و نه صرفاً میدان رهایی، بلکه عرصهای چندسطحی است که در آن ایدئولوژی هم تولید و بازتولید میشود و هم امکان انقطاع، نقد و مقاومت دارد. این جمعبندی راه را برای تحلیلهای پیچیدهتر در نظریه حقوق، بهویژه در حوزه مشروعیت، حقوق بشر و سیاستهای کیفری، هموار میکند. | ||
